Prepare Your Seller Disclosure
As we discussed in the Pre-Sale Inspection
section, in many states the seller is required to disclose known defects
about the property. Even if not required by law, it is always good policy
to disclose any known problems.
As a seller, it is your responsibility to understand the legal requirements
for your state. You may want to hire a real estate attorney to help you
understand and meet your legal requirements as well as assist you in the
negotiation of your purchase agreement.
You may be responsible for the following areas
of disclosure
This is not a complete list! Please make sure you check with your state
regulations to determine a for a complete list of items you are responsible
for disclosing.
Most states require the disclosure known defects that could affect the
value or salability of your home. Problems and defects include but are
not limited to: general condition of the home; seismic, geological, and
environmental hazards; physical defects (leaky roof); legal hinderances
(does the new bathroom conform to building codes); and structural pest
damage. Some states even require sellers to disclose the fact that a home
for sale is the site of previous meth lab or paranormal activity!
