Chhattisgarh was among the first states to implement the Real Estate (Regulation and Development) Act, 2016 (RERA), when it enforced the Chhattisgarh Real Estate (Regulation and Development) Rules, 2017, in November 2017. The Central RERA came into force in May 2017, following which various states notified their own versions of the law.

Key features of Chhattisgarh RERA

Project registration: All commercial and residential projects have to be registered with the CG RERA (Chhattisgarh Real Estate Regulatory Authority). However, there are exceptions to this rule. A project need not be registered with the CG RERA if:

Project updates: Builders are mandated to give the CG RERA quarterly updates on the status of the project.

Advance deposit: Under the state RERA rules, a builder cannot accept more than 10% of the cost of the property as an advance payment, without first entering into a written agreement for sale.

Escrow account: The builder has to deposit, in a separate account, 70% of the amounts realised for the project from the buyers. This has to be used to bear the cost of construction and the land purchase.

Interest on project delay: If the builder fails to complete or is unable to give possession of an apartment, plot or building, in accordance with the terms of the agreement for sale, he has to pay interest for every month of delay. If the buyer wants to withdraw from the project, because he has no other option, the builder has to return the amount received by him, with interest.

Project advertisement: Builders will have to showcase the project advertisement or prospectus, on the RERA site. This is done, to ensure that the builders provide all the amenities that they promise to the buyer.

Penalty on brokers: If a real estate agent fails to register with the CG RERA, he has to pay a penalty of Rs 10,000 for every day, during which such default continues. This may go as high as 5% of the property value or project, which has been sold without the broker acquiring a registration number.

Jurisdiction: Buyers who are not happy with the decision of the CG RERA, can file an appeal before the Appellate Tribunal under the state law. In case they are not satisfied with this verdict also, they can move the state high court.

Steps for builder/project registration on CG RERA

Step 1: Log on to the Chhattisgarh RERA website, https://rera.cgstate.gov.in/. Click on the ‘Registration’ tab on the top of the page.

 

Step 2: Go to the ‘Promoter/Project’ option from the dropdown menu and select ‘Online Application – Promoter (Saral)’.

 

Step 3: On the page that appears now, select from the two options, ‘New Promoter’ or ‘Existing Promoter’. Select the ‘New Promoter’ option and click on ‘Continue’.

 

Step 4: On the page that now appears, you need to go through six steps to complete the registration. These include keying in the promoter details, members that are to be added, project details, calculation of fees, payment details and the documents.

 

 

Step 5: Upon completion of all the steps, click ‘Save & Submit’ to register.

 

Step 6: If you are an existing promoter, select the other option in Step 3 and click ‘Continue’.

Step 7: Click on the ‘Submit’ button after entering the reference number.

 

Broker registration on CG RERA

Step 1: On the official website, go to the ‘Registration’ tab, select the ‘Real Estate Agent’ option from the dropdown menu and select ‘Online Application’.

 

Step 2: You will be redirected to another page, where you will have to provide various details, including personal and business details and payment details.

 

 

Step 3: Verify all the details and submit your application.
