How can housing societies in Maharashtra get deemed conveyance online?

Property owners of over 70,000 eligible societies in Maharashtra can apply for deemed conveyance in the state online with the state’s new portal – PRATYAY MahaBhumi starting May 26, 2025. In this guide, we detail the importance of deemed conveyance and how one can use the portal to get one.

 

What is deemed conveyance?

To get ownership right of a building and the portion of land on which it has been constructed, a conveyance deed is mandatory. In Maharashtra, it is the responsibility of the promoter to convey the title of the building and land to the cooperative housing society- as stated under Section 11 of the Maharashtra Ownership Flats Act (MOFA), 1963. This has to be completed within four months of formation of the cooperative housing society of the building. The builder or land-owner must convey the title within a period of four months of formation to a society or the legal body of the flat buyers.

Sometimes, the developer defaults and doesn’t give the conveyance deed within the specified time. In such a case, a housing society can get the deemed conveyance through a competent authority under the MOFA.

 

What are the charges to be paid for getting deemed conveyance?

A housing society can file an application for getting deemed conveyance by submitting all supporting documents and by paying a court fee of Rs 2,000.

 

What is the PRATYAY MahaBhumi web portal?

The PRATYAY MahaBhumi is part of the e-governance initiative of Maharashtra cooperation department. It will handle every stage of deemed conveyance including upload of documents, verification, hearing schedule and final order in an online way. With this portal, the entire process from uploading documents to issuance of a deemed conveyance certificate is completed within six months. The documentation etc. are done online and there is an option of holding the hearings for deemed conveyance offline, thus helping in ease of doing business.

Maharashtra has currently over 1.25 lakh registered housing societies of which 70,000 societies are eligible for deemed conveyance.
