Rajiv was in the process of buying a property in Maharashtra and taking a step in that direction, he paid the stamp duty for it. A disagreement in the deal, led the property transaction to be called off. But what happens to the stamp duty that Rajiv already paid? According to the Maharashtra Stamp Act, 2017, stamp duty can be refunded if a person whose signature is mandatory refuses to do so.
When can the stamp duty in Maharashtra be refunded?
- If the stamp is declared unfit for the purpose intended by any person before it is signed, unintentionally or by clerical error
- A stamp written in whole or in part but not signed
- A stamped document signed by either party.
Steps to file for stamp duty refund in Maharashtra
- Agree to the terms and conditions by clicking on check box. Next, click on New Entry.
- Enter mobile number, OTP, captcha and click on submit.
- You will see refund token number. Create password, confirm password, enter captcha and click on submit.
- Next click on whether you want to get old data or no.
- Enter refund token number, select on refund as stamp duty and fill all individual details and address and proceed.
- Next enter stamp purchaser’s details including bank account details where the amount will be refunded.

- Enter the reason for the stamp duty refund and select if the document is registered or not registered.

- Next upload documents and proceed.
- Once you follow these steps, you will get an acknowledgment.
Documents required for stamp duty refund
- Proof of reason of document being absolutely void in law from the beginning
- Copy of original document
- Cancelled blank cheque or first page of pass book where applicant name, bank name, bank account number and IFSC code are clearly seen.
How to view status of stamp duty refund in Maharashtra?
- Log on to https://appl2igr.maharashtra.gov.in/refund/
- Enter refund token number, password, captcha and click on view status. If you want to modify something click on modify.
