The district-level consumer panel in Mumbai has directed a Borivali housing society to pay Rs 1.25 lakh as compensative to an owner over its failure to address a leakage complaint.
Stating that a housing society’s responsibility is to protect member interests, the district consumer panel directed Ruby Apartment to pay resident Lourdes Dias, who had to shift to Goa because his house in the society had turned uninhabitable.
The commission has also appointed an expert commissioner who will find the source responsible for the leakage within two months and pay for the damages caused.
According to a report in The Times of India, Dias had filed the complaint in 2014 against the leakage citing that it was a result of the illegal renovation work carried in the building. The errant home owners changed pipelines, altered the kitchen’s position, toilet and bathroom and kept a 1,000 litre water tank in close proximity to the wall leading to seepage in her bedroom and bathroom. In addition to the housing society, Dias had also lodged complaints to the BMC and the local corporator.
