UP RERA imposes penalty of Rs 1.77 crore on 13 developers over non-compliance with orders

The regulatory authority has asked the promoters to submit the compliance report of its orders within 15 days and deposit the amount of penalty within 30 days.

The Uttar Pradesh Real Estate Regulatory Authority (RERA) has imposed a combined penalty amounting to Rs 1.77 crore on 13 developers over non-compliance with its orders. According to RERA Secretary Rajesh Kumar Tyagi, the non-compliance is related to issues such as delays in handing over flats to home buyers, refunds, and submission of approved maps in group housing projects.

The authority, during a meeting on December 19, 2022, reviewed the status of compliance of its orders by the promoters of the projects. It was observed that some builders were non-compliant despite being given sufficient time.

The RERA is making efforts to ensure the enforcement of its orders and deliver speedy justice to aggrieved allottees. The imposing of penalty against the guilty promoters is an important step towards compelling them to comply with the orders of the authority, Tyagi said. Given the above facts, the authority will impose appropriate penalty against the promoters to ensure compliance of its orders and protect the home buyers’ interest, he added.

The promoters imposed with the penalty include Gardenia India (Rs 62.13 lakh), Elegant Infracon (Rs 7.93 lakh), Rudra Buildwell Projects (Rs 3.12 lakh), Unibera Developers (Rs 6,31 lakh), K V Developers (Rs 6.67 lakh), Three C Green Developers (Rs 42.4 lakh), Suncity Hi-Tech Infrastructures (Rs 47,515), Antriksh Engineers (Rs 6.98 lakh), Anil Gupta (Rs 9.02 lakh), Idea Builders (Rs 6.80 lakh), Gardenia Developers AIMS (Rs 7.57 lakh) and Logix Infrastructure (Rs 9.6 lakh), the RERA said.

The provisions of section 38/63 of the RERA Act enables the regulatory authority to penalise non-compliant promoters with up to five per cent of the project cost. The authority has directed the promoters of the projects to submit the compliance report of its orders within 15 days and deposit the amount of penalty within 30 days, failing which the amount will be recovered as arrears of land revenue.

UP RERA is taking strict decisions against insensitive promoters for protection of home buyers’ interests. The regulatory body is committed to protect the interests of the home buyers and is taking all possible steps to regulate the real estate sector of the state in accordance with the RERA act, UP RERA Chairman Rajive Kumar said.
