All you need to know about Madhya Pradesh RERA

What is RERA MP?

The real estate (Regulation and Development) Act, 2016 was implemented in India in 2017. RERA MP is the real estate regulatory authority in Madhya Pradesh, one of the states in India, which has been very active in terms of implementing the rules and regulations of the Real Estate Act.  RERA MP has over 5013 registered projects and 566 non-registered projects. There are 1396 registered agents with the Madhya Pradesh Real Estate Regulatory Authority (RERA MP) and RERA MP has disposed 5468 complaints till now.

MP court sets aside RERA MP ruling 

The Madhya Pradesh court set aside an order passed by RERA MP that dismissed an application of a project because it was not stamped properly. RERA MP had taken this decision based on Section 4 of the RERA Act.

Justice Vivek Rusia pointed that if RERA MP had concluded that the property was not stamped properly, it should have directed it to IGRS Madhya Pradesh instead of dismissing the project application. The case in point was filed by Accrual Realities.

The Madhya Pradesh court in a ruling set aside an order dated April 19, 2022 that agreement on February 11, 2021 was not properly stamped. According to the court’s ruling, “The issue of payment of stamp duty be decided after giving opportunity of hearing to the petitioners. If respondent No.3 finds that any report is required from the Registrar/Sub Registrar of Stamps, then the same shall be obtained. If any deficiency of stamp duty is found, the petitioner should be given an opportunity to deposit the deficit stamp duty. Let the entire exercise be completed within 45 days from today”.

In the case, Respondent No. 3 is RERA MP.

RERA MP: How to search for registered projects/promoters?

Step 1: Log on to the official website of MPRERA, that is, http://www.rera.mp.gov.in/.

Step 2: Click on the ‘Projects’ tab and you can see an entire list of registered projects, applications under process, defaulters, as well as a list of completed, ongoing, extended, withdrawn, suspended and lapsed projects as recorded in MP RERA. As on April 27, 2023, there are 6814 registered projects. 3220 ongoing projects, 3050 extended projects, 209 withdrawn projects, 18 lapsed projects and 1 revoked project.

Note that at the time of login for project/agent registration status, you will be asked for password  that has to be entered after keying in reference number and PAN number.  In case password is not set, you can use OTP that you will receive on the registered mobile number.

RERA MP: How to register a real estate project?

Step 1: On the RERA MP website, Click on ‘Registrations’>> ‘Project Registration’ and proceed.

Step 2: You will be directed to a guidelines page on MPRERA. Read all the instructions given below.

RERA MP: Registration fees for project registration

Project type Amount to be paid to RERA MP Formula
Plotted residential Rs 10 per sq metre multiplied by the permissible floor area ratio (FAR) for all plots, including plots for common educational, recreational or health facilities, except green areas and roads. Area of total plotted land (in sq metres) x FAR x 10
Constructed residential Rs 10 per sq metre multiplied by the proposed carpet area of the residential units and common facilities and all other connected constructions (except shops, which have to be at the commercial rates) [Carpet area of the construction (residential units plus all common facilities) in sq metres x 10] + [Carpet area of all commercial units in sq metres x 20]
Plotted commercial Rs 20 per sq metre multiplied by the permissible FAR for commercial plots or plots for any other non-residential use. Area of total plotted land in sq metres x FAR x 20
Constructed commercial Rs 20 per sq metre multiplied by the proposed carpet area of the constructed commercial and non-residential constructions. Carpet area of all commercial and non-residential constructions in sq metres x 20
Mixed projects The fee calculates, shall be in proportion to the area proposed for residential and non-residential use; provided that educational, recreational and health facilities in a residential project shall be treated as residential. For ongoing projects (of planning/ non-planning areas):
Plotted residential Rs 40 per sq metre multiplied by the permissible FAR for all plots, including plots for common educational, recreational or health facilities, except green areas and roads. Area of total plotted land in sq metres x FAR x 40
Constructed residential Rs 40 per sq metre multiplied by the proposed carpet area of the residential units and common facilities and all other connected constructions (except shops, which have to be at the commercial rates). [Carpet area of construction (residential units + all common facilities) in sq metres x 40] + [Carpet area of all commercial units in sq metres x 40]
Plotted commercial Rs 80 per sq metre multiplied by the permissible FAR for commercial plots or plots for any other non-residential use. Area of total plotted land in sq metres x FAR x 80
Constructed commercial Rs 80 per sq metre multiplied by the proposed carpet area of the constructed commercial and non-residential constructions. Carpet area of all commercial and non-residential constructions in sq metres x 80
Mixed projects Fee shall be calculated in proportion to the area proposed for residential and non-residential use; provided that educational, recreational and health facilities in a residential project shall be treated as residential. RERA MP: How to pay registration fees?

After you calculate the fees based on parameters on MP RERA, you will be directed to make the payment. Choose your preferred mode of payment. On successful completion, you will receive a message from RERA MP. There is a transaction surcharge of 1% if the amount is Rs 2,001 to Rs 1 lakh and Rs 1,000 if the amount is greater than Rs 1 lakh. There is no transaction surcharge charged by RERA MP for amounts up to Rs 2,000.

RERA MP: Important documents required for project registration

While going about the RERA registration process, there are some documents that you require. They are:

Submission of hard copy: After submitting the online project registration application form through MPRERA web application on the MP RERA website, you will have to submit a hard copy of the RERA MP application form along with following documents:

  1. Khasra (Form B1) – photocopy.
  2. Affidavit for new project – original copy.
  3. Affidavit-cum-declaration (Form B) – Original copy or any other affidavits produced in the application.
  4. Sanction layout plan from TNCP in A3 size paper.
  5. Sanctioned building plan from the competent authority in A3 size paper.

RERA MP: How to register a real estate agent?

Step 1: To fill the RERA agent registration MP form, click on ‘Registrations’ >> ‘Agent Registration’.

Step 2: Filling up the form is simple. Charges are as follows: Rs 10,000 for individuals and Rs 50,000 for non-individuals.

RERA MP: How to file a complaint?

Step 1: Go to the ‘Complaint’ tab on the home page of MPRERA.

Step 2: Opt for Form M or N (compensation) and fill in the details available here.

Step 3: Submit the form and you will be redirected to the payment page on MP RERA.

Note: The complaint fee is Rs 1,000.

 

So far, the MP RERA authority has disposed of 4,897 cases, with final disposal being 1260 and 3637 transferred to adjudicating officer. Final disposal by AO is 2431 and there have been 117 100 interim orders.
