January 10, 2025: The Himachal Pradesh cabinet, in a meeting chaired by Chief Minister Sukhvinder Singh Sukhu, gave its approval to levy a uniform stamp duty rate of 12% on the transfer and lease transactions secured under Section 118(2)(H) of the Himachal Pradesh Tenancy and Land Reforms Act, 1972, with prior approval from the state government, according to media reports. The government has decided to promulgate an ordinance amending Schedule 1A of the Indian Stamp Act, 1899.
The move to keep a uniform stamp duty rate of 12% in the state implies a significant increase in the stamp duty rate for non-residents buying land in Himachal Pradesh. At present, non-residents purchasing land with state government permission are required to pay stamp duty ranging from 6% to 8%. The new rate aims to generate significant revenue for the state, according to Revenue Minister Jagat Singh Negi, as cited in an Indian Express report.
Those buying properties are required to pay stamp duty to the state’s revenue government. Currently, the stamp duty rate in Himachal Pradesh is 6% for male property buyers while it is 4% for female property buyers. The registration charge is 2% of the property value with an upper limit of Rs 25,000.
