What is the Maharashtra Kul Kayda law?

The Maharashtra Kul Kayda law maintains the landlord-tenant relationship for agricultural land. Under the Maharashtra Kul Kayda law, there is a cap on the ownership of agricultural land by an individual or his family in the state. If the individual or his family has excess land, it is taken over by the government. This land is distributed to landless farmers. With this law, equal land distribution is encouraged and the issue of the same income within the agricultural segment is addressed.

 

Who is the landlord?

A landlord is the owner of a property or an agricultural land.

 

Who is a tenant?

A tenant is the one who rents the land, based on some mutually agreed conditions, from the owner and pays rent for it. The tenant’s name is mentioned in the Mahabhulekh 7/12 as protected ‘kul’ and they can cultivate the agricultural land with the farmer’s legal permission.

 

How much land can a person hold in Maharashtra?

A person can hold 54 acres of land in Maharashtra. Anything beyond this is taken by the government under the Kul Kayda law.

 

Kul Kayda law: Key initiatives

Under Section 43 of this Act, any land acquired by a tenant may not be sold or transferred without the prior approval of the collector. Land reforms in Maharashtra include the government’s efforts to enhance the agricultural sector by introducing various laws and initiatives.
