The Bombay High Court (HC) has asked the Maharashtra Housing and Area Development Authority (MHADA) to find out whether it could take assistance from the state real estate regulator to find developers who can help complete stuck redevelopment projects.
A Division Bench of Justice Gautam S Patel and Justice Neela K Gokhale on February 3, 2023, made this suggestion while hearing a plea in which a housing society asked the MHADA to decide the course of action on redevelopment of buildings that were abandoned after part construction.
The HC highlighted that that the MHADA and cessed building’s housing societies should take a well-thought out decision before getting into a developer agreement so that the project was not affected. The HC also wondered if the state RERA had a rating system to determine a developer’s credibility. The Bench clarified that this was not a notification to the MahaRERA.
Note that MHADA had got president approval on amendment of the MHADA Act, 1976 under which almost 56 buildings demarcated as ‘dangerous for living’ by municipal bodies could go ahead with redevelopment works. However, no decision has been made on buildings that went for redevelopment and was abandoned halfway. Next hearing of the petition is scheduled on March 3, 2023.
