July 12, 2024: The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has directed all industrial and housing development authorities to clearly identify parts of projects before issuing part-wise completion certificates (CC) or occupancy certificates (OC). The regulator highlighted that this directive has been issued owing to mismatch in details given by promoters during the UPRERA project registration.
According to the regulatory body, such Part-CC or OC creates doubts in the mind of the homebuyer about the status of completion of his unit or tower at the time of the execution of conveyance deed and handing over of possession of the unit.
The authority also mentioned that issuing temporary CC or OC is not permissible under current laws and could adversely affect homebuyers. “These can be seriously detrimental to homebuyers who take possession on the basis of such temporary OC or CC and subsequently, because of some reason or the other, such temporary OC or CC is not confirmed by the concerned planning authority,” said the UP RERA according to reports.
To avoid mismatches between project names and their blocks or towers, the UP RERA has directed planning authorities to get marketing names of projects, along with the number of units, from promoters during the application for map sanction.
