May 3, 2024: The Telangana Real Estate Regulatory Authority (TSRERA) bench consisting of Justice N Satyanarayana (chairperson), K Srinivasa Rao (member) and Laxmi Narayana Jannu (member) has directed the developer of Empire Meadows apartments located in Sangareddy District, Hyderabad to repair the project’s structural defects following the transfer of possession to the homebuyers. The ruling is under section 14(3) of the Real Estate (Regulation and Development) Act (RERA), 2016.
The case – complaint number 1400 of 2023, was filed by Chandrashekar Laxmi Sudha and Laxmxi Sudha Bhaskabhatla, residents of Empire Meadows apartments located in Sangareddy District, Hyderabad. In their complaint, the homebuyers asked for redressal of the issues complained and sought damages of Rs 1,00,000 for incomplete construction.
The homebuyers had entered into an agreement with the developer on February 14, 2020 to purchase residential 3 BHK flats spread across 1590 sqft for Rs 66, 95, 000. Although the entire sale consideration amount has been paid, the property was registered as a semi-finished flat with the sub-registrar of properties (Sangareddy vide sale deed no. 23798/2020 for the amount of Rs 19, 08,000). Also Rs 30,000 was paid towards corpus fund to Empire Meadows after the registration of the said flat.
According to TS RERA, the project should have been completed by 2022. However, as per the complaint registered with TS –RERA, many blocks and amenities that are part of the project are still under construction leading to ambiguity in the completion date.
Incomplete drainage lines for new blocks and open drainage and rainwater lines have resulted in water logging, leading to hygiene issues. Issues like no parking allocated, delayed construction of amenities have led to inconvenience and even health hazards to residents because of dust and noise pollution.
The TS-RERA ordered the developer to develop the rocky area adjacent to the clubhouse into a landscaped area and hand it over to the homebuyer association in addition to the amenity block.
