UP RERA introduces standard format for written arguments

As per Section 31 of RERA Act, 2016, aggrieved buyers and real estate promoters or builders can file complaints before the authority.

June 18, 2024: In a move to ensure transparency in home buying, the Uttar Pradesh Real Estate Regulatory Authority (UPRERA) has prepared a standard format for written arguments to ensure the speedy resolution of ongoing cases at its headquarters and regional offices.

UP RERA has said it will only accept submissions in writing as home buyers change their sought relief after the final order causing unnecessary delay in the disposal of complaints. The complainant will have to present the complete property details, the agreement for sale, payments made to the promoter, their complaint and the relief requested before the RERA bench in writing according to the format.

As cited in reports, officials said the authority has made a provision for the complainant to present their arguments in writing to strengthen their matter before issuing the final order according to the requested relief.

An official said, as stated in the report, that in many matters, the authority found that after pronouncing the final order in the matters heard before the RERA bench, the complainants are changing their sought relief. Due to the lack of clarity in the requested relief by the complainant, a situation of doubt and confusion arises on the final order received from the bench and it causes unnecessary delay in the disposal of complaints.

Sanjay Bhoosreddy, chairman, UP RERA, said, “We have seen in many cases that the complainant deviates from his sought relief due to which the time and hard work of the authority, as well as other stakeholders, get wasted. To further strengthen the judicial process, the authority will now issue the final order based on the submission of the sought relief in writing from the complainant so that the complainant can get a satisfactory final order”.
