December 28, 2023: Uttarakhand is likely to make key amendments in its land law, which, once implemented, can make it difficult for outsiders to buy land and own a house in the state, according to media reports. The proposed law focuses on protecting the interests of the state by restricting land acquisition by non-natives in the rural hill areas.
According to a report by the special committee formed by chief minister Pushkar Singh Dham, the new land law incorporates provisions for strict restrictions on land purchases in non-municipal hill regions similar to section 118 of Himachal Pradesh Tenancy and Land Reforms Act 1972, a member of the special committee said, as cited in a report by The Statesman.
In 2003, the government had introduced an amendment that allowed outsiders to buy land in hill areas but only up to a limit of 500 square metre (sqm). The limit was further reduced to 250 sqm to prevent the sale and purchase of large plots in hill districts.
In 2017, the government lifted all restrictions to attract investments by making amendments in the UP Zamindari Abolition and Land Reforms Act, 1950. The land purchase limit was raised from 12.5 acre to 30 acre for work related to tourism, energy, industry, agriculture and horticulture, according to a TOI report.
The state government has formed a five-member committee for a detailed study of a draft report submitted by a panel headed by ex-chief secretary Subhash Kumar in 2022, which had made 23 recommendations. Citing sources, the report mentioned that based on the recommendations the state may limit the sale and purchase of land in the hills to 12.5 acre again.
