CIDCO reconstruction policy amended; only 51% member consent required for building redevelopment

As per the amendment, a building in Navi Mumbai can be reconstructed with the consent of only 51 percent of the members of the housing society instead of the earlier 100 percent

Revising its reconstruction policy, City and Industrial Development Corporation (CIDCO) on January 20, 2023 mentioned that consent of only 51 percent members are required for redevelopment of a building in Navi Mumbai.

“The CIDCO has included a provision that the building can be reconstructed with the consent of only 51 percent of the members of the housing society instead of the earlier 100 percent” the town planning authority in Navi Mumbai said, according to media reports. The new guideline is a revision to CIDCO’s reconstruction policy drafted in 2013 where it was mandatory to have permission of 100 percent members of the housing society to go ahead with reconstruction of a building.

According to the provisions of the Navi Mumbai Disposal of Land (amendment) Regulations, 2008, CIDCO allots plots on lease in Navi Mumbai. Based on the lease agreement, a housing society should take permission beforehand to demolish an existing building and construct a new one in its place.

Under the amended policy, 51 percent of the total members in a housing society will have to give their written consent as an affidavit to CIDCO for redevelopment of the building.  The other terms and conditions with respect to redevelopment in Navi Mumbai is status quo. This amendment will aid in faster decision making and reconstruction of old buildings in the satellite city.
