A special bench of Chief Justice UU Lalit will hold a special hearing of the pending Amrapali Group cases on October 22, the Supreme Court said on October 19, 2022. The CJI will also consider the bail petitions of the former Amrapali group directors Anil Sharma and Shiva Priya among other pending matters.
The move by the SC to hold court on a non-working day — October 22 is a Saturday — comes in the backdrop of the announcement of Chief Justice UU Lalit’s retirement date. Recall here that CJI Lalit is set to retire on November 8, 2022, after a brief tenure of only 74 days. Justice D Y Chandrachud is to be the CJI after his retirement. Also recall here that CJI Lalit has been hearing this case since 2018.
“We will hold the court on Saturday and besides bail pleas of directors, we will take up only those issues which are important,” the CJI said.
During the hearing, the top court will address issues related to finances—from what the now-defunct company owes to lenders to Noida and Greater Noida Authority’s contention on sale of additional FAR in Amrapali projects.
India’s top court has been hearing the Amrapali Case since 2017 when a homebuyers group moved the SC against the NCR-based developer over charges of project delays and financial misappropriations. Eventually, the company went defunct and state-run NBCC was given the charge to complete its pending projects. Since funds continue to be an issue, the apex court has been trying to find new ways of arranging funds to complete ongoing projects.
