The introduction of the Real Estate Regulation Act (RERA) Act, 2016, has helped strengthen the trust and confidence in the sector. Prior to this, the industry was largely governed by local regulations. The TGRERA is the state-level authority established under the RERA act to regulate the sector. The authority also maintains an official website, allowing buyers and promoters to access various services online, thereby promoting transparency in the sector. In this guide, we explain the processes for RERA registration, how to view RERA-registered projects, and how to register complaints with RERA in case buyers face any issues.

 

What is Telangana RERA?

Under the RERA Act, the Telangana government notified the Telangana Real Estate (Regulation & Development) Rules 2017 on July 31, 2017. The Apellate Tribunal has also been designated. The Value Added Tax (VAT) Appellate Tribunal served as the interim RERA Appellate Tribunal until a permanent Tribunal was designated in the state.

How to register a complaint with TGRERA?

  • To register complaints with RERA in Telangana, visit the official RERA website https://rera.telangana.gov.in/
  • Scroll down the home page. Click on ‘Make a compliant’ under Citizen Corner.

Procedure to file complaints for non-RERA-registered projects

In case a buyer has invested in a project that is not registered under TGRERA, there is a provision to raise complaint in case of any issue. Before that, it is essential to verify if the project falls under the RERA Act. In case it is and the builder has not registered it, then this is a valid reason to lodge a complaint. Here are some options available for the buyer:

  • File a complaint with the consumer court (district, state or national) for issues pertaining to project delays, fraud or poor construction quality.
  • Approach a lawyer who will send a legal notice to the developer, demanding action within a specified timeline. In case the developer fails to respond, a complaint with consumer court can be filed.

The buyer should ensure that they have all the required documentation, such as the builder-buyer agreement, payment receipts, allotment letter, and bank statements. In case the developer, fails to deliver or refund, then a Corporate Insolvency Resolution Process (CIRP) under the Insolvency and Bankruptcy Act (IBC) can be initiated.

 

How to register as promoter or agent with TGRERA?

  • To register with TGRERA, visit the official website https://rera.telangana.gov.in/

  • Click on project registration/ agent registration. The login page will open. 
  • Click on ‘New Registration’
  • Users will have to select user type – Promoter or Real Estate Agent
  • Complete the form with relevant information such as name, photograph and contact details of the promoter (for individuals) or name, address and contact details of the chairman, partners, and directors (for businesspersons)
  • Click on ‘create user’ to proceed.

 

How to register projects with TGRERA?

  • Click on project registration. The login page will open.
  • Login using username and password. Enter the captcha code.

  • Provide relevant information. Upload supporting documents. 
  • Complete the payment process.

TGRERA fee for project registration

For residential projects having less than an area of 1,000 square metre, a fee of Rs 5 per sqm is applicable for project registration. If the area is more than 1000 sqm, the registration charge is Rs 10 per sqm. However, the maximum limit for the fee is around Rs 5 lakh. 

Moreover, in case of a mixed-user project like a commercial cum residential project, the fee for registration is Rs 10 sqm in case the land area is less than 1000 sqm. However, if the land is more than 1000 sqm, a fee of Rs 15 per sqm is applicable. The maximum fee limit is Rs 7 lakh.

For promoters

  • Registration application form for the regulatory authority
  • Registration fee paid via a demand draft or cheque or online payment
  • Verified copy of the promoter’s PAN card
  • Copy of title deed
  • Recent three years’ balance sheets and profit and loss statements 
  • Recent three fiscal years’ annual report, director’s report and auditors’ report
  • Details of about open and closed parking spaces available inside the project
  • Specifications of landowner’s authorisation and related documents, in case promoter is not the owner of the plot

For agents

  • Identity proof: Valid government ID such as Aadhaar card or passport
  • Address proof: Documents such as Aadhaar, utility bills or rental agreement
  • Photograph: Latest passport-sized photographs of the applicant
  • PAN Card: Copy of the PAN card 
  • Business registration proof: For entities, registration certificates or partnership deeds
  • Bank account details: Proof of a valid bank account linked to the agent or entity
  • Registration fee receipt: Payment proof of the prescribed registration fee
  • Additional documents: Any agreement or property tax receipts related to the agent’s business
