Karnataka HC asks BBMP to digitise old property records

The Karnataka High Court said access to all the documents should be available to all authorised officers.

October 20, 2023: The Karnataka High Court has directed the Chief Commissioner of Bruhat Bengaluru Mahanagara Palike (BBMP) to initiate the digitisation of all the old property records such as Khata certificates, tax paid receipts, self-assessment forms, etc., according to media reports.

The move will ensure that the old property records are digitally tagged to all other documents relating to a particular property. The court observed that the documents for a particular property are available with other departments such as the revenue department, urban development department, planning authority and sub-registrar office. Thus, these documents are required to be mapped and tagged to the said property. Thus, this will provide access to all digitised property-related documents to the officers authorised to take penal action under the BBMP Act.

As per reports, Justice Suraj Govindaraj passed the order while allowing a petition filed by Aslam Pasha, a resident of Padmanabha Nagar, questioning the order passed by the BBMP chief commissioner, which stated that the petitioner’s construction was illegal since the sanctioned plan had not been produced. The petitioner had claimed that there existed a sanctioned plan, but there had been a delay in producing the document before the BBMP authorities.

Further, the court stated that though various departments of the BBMP deal with different aspects, the civic authority is a single entity encompassing all these departments. Thus, access to all the documents should be available to all authorised officers.

When the BBMP possesses the documents in its custody, it cannot call upon the citizen to furnish such documents and cannot draw any adverse inference for non-production, as done in the present case. It noted that if the documents were not produced, nothing prevented the officials from examining the authority’s own records.

 

How to check property records online in Bangalore?

The Karnataka government introduced the Bhoomi RTC online portal to allow landowners to search for detailed information such as Pahani, Mutation register, RTC information, Mutation extract, etc. Citizens can register on the site and check details based on district, taluk, hobli and village name.
