March 19, 2024: The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) on March 18, 2024, urged homebuyers to include co-allottees’ names in their complaints and assured that necessary provisions were being made on its portal for this purpose. Some complaints were disposed of without considering all co-allottees, leading to incomplete hearings.
There have been instances where a co-allottee discovered their exclusion from a complaint, resulting in a loss of opportunity to protect their interests during RERA proceedings. Therefore, UP RERA decided to mandate the inclusion of co-allottees as co-complainants in complaints filed by allottees.
Joint allotment, involving spouses, family members or non-blood relations like partners, often leads to disputes. The absence of co-allottees’ names in RERA complaints causes delays in resolution and further proceedings. Henceforth, complainants must add co-allottees named in the Agreement for Sale (BBA) and allotment letter as co-complainants in future complaints.
Those with pending complaints were instructed to promptly submit applications to add co-allottees’ names. This applies to complaints before the Bench, for order enforcement, rectification or compensation adjudication. UP RERA facilitated online submission of such applications to ensure swift action. The directive aims to ensure justice for all parties and safeguard the interests of all unit allottees. The order, issued on March 5, 2024, is accessible on the portal.
