April 24, 2024: The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) on April 23, 2024 imposed Rs 5,000 as penalty on a property buyer who had asked for compensation for delay in possession and registration of a unit.
However, the penalty was levied because the buyer was filing a complaint with the regulatory body for the fourth time, a matter that was already decided by the UP RERA bench. This is the first time, the regulatory body is penalising a home buyer.
As per media reports, the allottee had already received possession of the unit in a commercial project in Noida Extension. Taking strong objection to the fourth complaint, Sanjay Bhoosreddy, chairman, UPRERA imposed a cost of Rs 5,000 on him. According to the regulatory body while it is providing justice to large number of allottees, there are also instances where some allottees file repeated complaints in the same matter, thus misusing law.
Number of complaints | Reason | Ruling               | Result |
First | Possession of the unit and payment of interest for delay | UP RERA directed the promoter to provide possession with registered sub-lease deed and pay the interest for delay in possession. | The promoter complied with the order, paid interest of Rs 2.68 lakh for delay. |
Second | Same relief as above | Complaint dismissed as ruling passed and relief given.
Third | Complaint filed before adjudicating officer of RERA seeking compensation. | Adjudicating officer ordered compensation of Rs 50,000 to be paid to the buyer.
Fourth | Same relief as above | UP RERA chairman imposed penalty of Rs 5,000 for filing complaint for which he got relief for the fourth time. |
