February 13,2024: With an intent to dispose off cases at a faster pace, the Uttar Pradesh Real Estate Regulatory Authority (UP RERA) started the pre-hearing scrutiny of complaints on February 12, mention media reports.
Under the new process, UP RERA’s legal division will go through the complaint and determine its validity based on details in the allotment letter. It will also check if details about the person who has filed the complaint – home buyer or promoter and the project about which it has filed the complaint are correct. Also checked will be the self-attested relevant property documents for UP RERA’ perusal.
Once checked, if there is a need for correction, UP RERA will inform the complainant and give him 15 days to make the changes. An extension of 15 more days will be given if the changes aren’t made by the deadline. Once the changes are made, the legal bench will mark the complaint as fit for hearing and send it to the bench for hearing. If the changes are not made inspite of a second extension, the case will be forwarded to the bench and the incomplete details will be marked. Such cases will lose the opportunity of a speedy trail.
In the UP RERA, one can file complaints through the e-courts system. A revised standard operating procedure (SOP) to file complaints by the homebuyers and promoters on the e-courts system was announced in December 2023. UP RERA started providing the facility from January 15, 2024.
