UP Rera issues notices to 130 real estate promoters over illegal ads

This action comes in the wake of a growing trend of non-compliance observed by the regulatory body.

December 4, 2023: The Uttar Pradesh Real Estate Regulatory Authority (UP Rera) on December 1, 2023, issued notices to 130 promoters across the state for violating norms related to advertisement of registered real estate projects. This action comes in the wake of a growing trend of non-compliance observed by the regulatory body, despite granting promoters a review period, as highlighted in an official statement by Chairman Sanjay Bhoosreddy, according to a PTI report.

In recent months, UP Rera has proactively issued directives concerning the promotion and advertising of both registered and unregistered projects. These directives specifically outlined the importance of prominently displaying the Rera registration number and portal details. Furthermore, promoters were urged to upload the coordinates of a designated director for effective communication. The regulatory body also emphasised the necessity to update and correct project details on the Rera portal, maintain active telephone numbers for consumer queries, appoint knowledgeable personnel for consumer interactions and activate helpline numbers for mega projects.

The comprehensive guidelines issued by UP Rera also included providing detailed information in project registration applications, specifying all three bank accounts with standing instructions to banks to expedite the project registration process, utilising the model agreement for sale available on the portal for consumer agreements and uploading all Quarterly Project Reports (QPRs) for the approval of extension applications, among other stipulations.

During the regulatory review, it was identified that out of a total of 1,810 promoters, only 666 had adhered to the directive of uploading director details for correspondence. This indicates a significant gap in compliance with the promotion guidelines. Subsequently, approximately 130 notices have been issued to promoters found in violation of advertising norms. Citing the provisions of Section 37 of the Rera Act, UP Rera has issued office notices to these promoters, urging them to ensure compliance with the issued directions. Additionally, the regulatory body, empowered by Section 63 of the Rera Act, retains the authority to take stringent actions and impose appropriate penalties for non-compliance.
