What makes it worse is the fact that some sort of ambiguity always prevails in the interpretation of those terms. What is land patta?

Even though India is touted to become the third largest economy in the world by 2027, about 40% of the Indian population still depends on agriculture for its survival. To enable this segment, the government has allocated land to land-less farmers in the country for a specific tenure. Similarly, government agencies responsible for developing housing units for low-income groups and economically weaker sections also offer the unit to the buyer as patta.

Patta is the word used to define this arrangement. To put it succinctly, land patta is basically land lease. The revenue department of a state in India is responsible for maintaining records of all lease agreements. So, one can access the land patta records easily online. In record of rights, the lessee is referred to as patta-dhari, the lessor as patta-data and the leasehold property as patta-dhriti.

 

Can patta land be sold?

As the patta-dhari enjoys the right on his land as a tenant, he has no authority to sell such properties. In some cases, the government offers patta land on condition that the patta-dhari will not be able to transfer its ownership for a specific period.

 

How to find patta document?

With nearly all states bringing records of right online, people interested in getting details on patta land can visit the official website of the state revenue departments and view the land patta online.

  • Name of the landowner’s father or husband
  • Address of the landowner
  • Plot number of the land parcel
  • Total area
  • Details related to loans taken by the landowner from government agencies
  • Details of pending litigations
  • Details of paid and unpaid taxes levied on land
  • Place where land parcel exists
  • Signature of the landowner
  • Details of the registration fee or stamp duty paid by the landowner
  • Signature of the district revenue officer or the tehsildar
  • Full name of the district revenue officer or the tehsildar
  • Official stamp of the competent government office or authority
  • Date of issuance of ownership certificate

 

How can the tehsildar’s office help in getting land patta?

Tehsildar is an Arabic word used for the chief revenue official of a taluka in India. While land records are available online, they don’t act as the proof of ownership, till they carry the signature of the tehsildar. In some states, tehsildars still issue patta documents in physical form bearing their signatures.
