A Delhi High Court bench of chief justice DN Patel and justice C Hari Shankar, on July 24, 2019, issued notice to the Real Estate Regulatory Authority (RERA) and the Delhi Development Authority (DDA), seeking their stand on a public interest litigation by Abhijit Mishra, a financial economist, who contended that the DDA violated the real estate regulation laws, by not registering its housing scheme of 2017 and 2019 with RERA. The HC sought their responses by the next date of the hearing on November 19, 2019.

The petition, filed through advocate Payal Bahl, has claimed that DDA has not provided RERA with the completion certificate, commencement certificate and occupancy certificate of the projects under its housing schemes of 2017 and 2019. The land-owning agency also did not provide to RERA a copy of the authorised prospectus of the sanctioned plans of the projects under the two schemes, the petition has contended and added that the DDA was in default of the provisions of the Real Estate (Regulation and Development) Act, 2016.

“The DDA has not been granted exemption from registration of its housing scheme-cum-project under the statutory provision of the Real Estate (Regulation and Development) Act, 2016. Thus, it was a deliberate and malicious attempt by the officers of DDA to contravene the laws of the land,” the petition has said. Mishra, in his plea, has sought directions to the DDA to suspend the allotment process of the apartments under its 2019 housing scheme, until it completes the formality of registration of its project with RERA. Apart from that, he has sought directions to RERA to take appropriate action against DDA and also set up ‘a committee to investigate and audit the quality standards of its real estate project under the housing schemes of 2017 and 2019, for their structural integrity as per the National Building Code of India, 2016’.

Lt Governor launches RERA Delhi portal

June 27, 2019: Lt Governor Anil Baijal, has launched the official portal of RERA Delhi, saying it will promote transparency and accountability in the real estate sector. “We have launched the official portal of RERA, Delhi (https://rera.delhi.gov.in). The website will help promote transparency and accountability in the real estate sector. Advised to provide an interactive forum for knowledge sharing with other RERAs. I congratulate the RERA team for the initiative,” the L-G tweeted after the launch.

The government of India implemented the Real Estate (Regulation and Development) Act 2016 (RERA), to check malpractices in the sector. The Act came into force on May 1, 2017. The RERA aims to reform the real estate sector in the country, encouraging greater transparency, citizen-centricity, accountability and financial discipline.

Delhi RERA gets 72 complaints against builders: RTI reply

Only 16 projects have been registered under the Delhi RERA, while the authority has received 72 complaints and resolved 24 of them, an RTI query has revealed

May 22, 2019: As many as 72 complaints have been received against builders in Delhi, under the central real estate law, according to an RTI reply. According to the Delhi Real Estate Regulatory Authority (RERA), out of 72 complaints, 24 have been resolved till last week. Only 16 real estate projects have so far been registered under RERA in the national capital, it said.

Under the Real Estate (Regulation and Development) Act, 2016, all states are mandated to constitute their respective real estate regulator, which provides proper protection to home buyers. “Seventy-two complaints have been received against builders in Delhi. Out of which, 24 have been resolved,” Delhi RERA said, in reply to an RTI query. Responding to a question about action against builders, the real estate regulator said that either the applicant gets possession of the property or he may get a refund of the amount.

In November 2018, Delhi got a full-time real estate regulator under the RERA, with Lt Governor Anil Baijal appointing retired IAS officer Vijay S Madan to the post. The Act was enacted by Parliament and states were given powers to notify their respective rules and appoint regulatory authorities.
