The Mahabocw or the Maharashtra Building & Other Construction Workers Welfare Board has an official website that provides online registration and other facilities for workers.

Construction workers are among the vulnerable sections of the labour force in India and a significant number of these workers belong to the unorganised sector. Nearly every state in India has constituted a Building & Other Construction Workers Welfare Board, which is responsible for formulating various welfare schemes for the workers. In Maharashtra, this board is known as the Maharashtra Building & Other Construction Workers Welfare Board or Mahabocw. The board launched the MAHABOCW portal on April 18, 2020 to enable the beneficiaries to access various facilities online.

Mahabocw: Overview

The central government introduced the Building & Other Construction Workers (Regulation of Employment and Condition of Service) Act, 1996, aimed at regulating the employment and service conditions of the building and other construction workers in India and to provide them with various safety, health and welfare measures.

Under the Act, the Maharashtra government passed The Maharashtra Building & Other Construction Workers (Regulation of Employment and Condition of Service) Rules 2007. It established the Maharashtra Building & Other Construction Workers Welfare Board with five government representatives.

The Mahabocw was restructured under notifications of 2011, 2015 and 2018 and formed a tripartite board. Presently, it comprises the chairman and three representatives each from government, owners, and labour sections.

As on March 2019, the Board had a total number of 18,75,510 registrations with 20,28,903 beneficiaries.

Mahabocw scheme

The MAHABOCW scheme is also referred to as Construction Workers Scheme, Maharashtra Construction Workers Scheme, Mazdoor Sahayata Yojana and Maharashtra Corona Sahayata Yojana.

Under the MAHABOCW scheme, eligible working citizens of the state are eligible to get financial assistance ranging from Rs 2000 to Rs 5000. In addition to this, the beneficiaries can access other benefits through the MAHABOCW portal.

Through the scheme, the Maharashtra government aims to provide financial support to around 12 lakh construction workers in the state, those who were impacted by the pandemic. To be eligible for the scheme, the beneficiaries must register on the MAHABOCW official website.

Step 3: On the next page, the Maharashtra construction workers registration form will be displayed. Fill in the details such as name, father’s name, Aadhaar number, date of birth, residential address, family details, bank details, employer details and details of 90 days working certificate.

Step 4: Upload the supporting documents online. The Mahabocw online portal provides the registration form that can be downloaded. All the relevant forms for self-declaration, Aadhaar consent, 90 days working certificate, etc., are available on the portal under the ‘Download’ tab.

Step 5: Click on the checkbox for declaration. Then, click on ‘Save’.

You will get an acknowledgement number that must be saved for reference. Then, visit the nearest WFC office with the original documents for verification to complete the further process.

Mahabocw online registration: Documents required

To register with the Mahabocw, one should fill and submit the form known as Form-V and provide supporting documents such as:

  • Identity proof
  • Age proof
  • Residence proof
  • 90 days’ working certificate
  • Three passport-sized photographs

The Maharashtra BOCW registration fees for workers in Maharashtra is a nominal amount. Additionally, a registration fee of Rs 25 and an annual subscription fee of Rs 60 for five years are applicable. The subscription fee can be paid through two methods based on the time period:

  • The charges applicable for annual subscription of five years is Rs 60
  • The charge for monthly subscription is Rs 1

1. Construction worker: Apply online for claim

Workers can fill and submit the claim form online, to avail the benefits of Mahabocw. Click on the ‘Construction Worker: Apply Online for Claim’ tab on the home page. On the next page, select the right option from the dropdown – new claim or update claim. Enter the registration number. Also, provide the acknowledgement number in case it is applicable. Then, click on ‘Proceed to Form’.

2. Construction worker online renewal

This facility allows the workers to renew the worker registration online for Maharashtra Building And Other Construction Worker’s Welfare Board. Click on ‘Construction Worker Online Renewal’ on the homepage to apply for renewal. Complete the OTP verification by providing the registration number.

The BOCW renewal form will be displayed. Fill out the form by providing relevant details, such as the name of the contractor, company name, mobile number, type of work, location details, employment details, etc.

Upload the relevant documents. Click on the self-declaration checkbox and then click on ‘Save’. Complete the further process by visiting the nearest WFC office.

There are four types of welfare schemes offered to registered construction workers by the Maharashtra Construction Workers Welfare Board. The scheme covers social security, health, education and financial benefits for the workers and their family members.

Where is the BOCW Act applicable? 

The Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Bill was passed by both the Houses of Parliament received the assent of the President on August 19th 1996. It came on the Statute Book as The Building and Other Construction Workers (regulation of employment and conditions of service) Act, 1996 (27 of 1996).

The act applies to every establishment which employs or had employed, on any day of the preceding twelve months, ten or more building workers in any building or other construction work.

 

Who is the employer under BOCW?

The employer, in relation to an establishment, refers to the owner and the contractor. The contractor includes a sub-contractor. Building and Other Construction Workers Welfare Cess Act, 1996 (‘Welfare Cess Act’) provides for the levy and collection of a cess on the cost of construction incurred by an employer.
