Mandatory for MahaRERA agents to get ‘certificate of competency’

Only after agents have ‘certificate of competency’, they can render professional services.

The MahaRERA conducted the competency exam on May 20, 2023.  Out of 423 real estate agents in the first batch, 405 cleared examination.

Maharashtra Real Estate Regulatory Authority (MahaRERA) on Jan 10, 2023 issued an order making it mandatory for the over 38,771 agents registered with them to take up the course developed for them in association with Institute of Banking Personnel Selection (IBPS). Once the exams are cleared, the agents will be provided a ‘certificate of competency’, post which only they can render professional services.

MahaRERA identified 39,000 real estate agents across Maharashtra who will be trained as part of this initiative in the first batch. Four agencies have been given responsibility of giving training including National Real Estate Development Council (NAREDCO). The training is aimed to be completed by September 2023.

The course includes a basic curriculum for realty agents developed in consultation with association of real estate agents, home buyers, promoters and All India Institute of Local Self Governance (AIILSG). Starting February 2023 first week, the training will be provided online, offline and in hybrid form as per the agent’s convenience. Guidelines outling the real estate agents training and certification process shall be issued by MahaRERA shortly.

“In order to bring about certain level of consistency in the practices of real estate agents, enhance knowledge and awareness of the regulatory and legal framework and practices, enforcement of code of conduct and with a view to ensure that real estate agents are professionally qualified to help / assist home buyers / allottees, MahaRERA proposes to introduce basic real estate agent training and certification course for real estate agents across the State of Maharashtra,” mentioned the MahaRERA order signed by Dr. Vasant Prabhu, Secretary, MahaRERA.

Effective May 1, 2023, agents having the MahaRERA Real Estate agent ‘Certificate of Competency’ can only apply for agent renewal or registration with MahaRERA. Existing registered realty agents have to obtain and upload the MahaRERA Real Estate agent ‘Certificate of Competency’ before September 1, 2023 on the webpage, failing which action will be taken. Also, in line with this order, effective September 1, 2023, developers have to ensure that the names and addresses of agents given by them should be only such agents who have MahaRERA Real Estate Agent ‘Certificate of Competency’.

With this mandate, Maharashtra is the first state to introduce such a certification course under RERA for real estate agents.
