March 7, 2024: The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has introduced changes in the time limit for uploading of project documents by the parties, according to media reports. Developers and homebuyers whose cases are being heard at UP RERA are required to submit all the documents related to the project at least 48 hours before the hearing. The move is aimed at preventing repeated adjournments in cases due to the absence or late filing of documents and delays in submitting objections or counter-objections during RERA hearings.
UP RERA has decided to lock the facility for uploading of such documents two days prior to the hearing. This will also enable RERA to have ample time to study the case files, which can lead to quick disposal of complaints.
As cited in a TOI report, UP RERA chairperson Sanjay Bhoosreddy said that UP RERA conducts hearings through e-courts where parties participate in the hearing virtually. Both the RERA benches and the parties have been experiencing difficulties because of the late filing of the documents, objections or counter-objections by some of the parties, sometimes as late as the start of the hearing itself.
As a result, the other party does not get sufficient time to submit its reply and prepare its case in advance. The authority benches also do not get sufficient time to study the case, thereby leading to the adjournment of the case for reply by the other party. Such a situation defeats the object of RERA to expeditiously decide the case and impart justice to the aggrieved persons, he said.
