The stamp duty is a state-determined tax a homebuyer is responsible for paying in order to get the property title converted in his favour. Step 1: Visit the official website of the SHCIL at  https://www.stockholding.com/. Click on ‘products and services’, choose ‘e-Stamp services’ and finally select ‘e-Stamping’.

Step 2: Select the state from the dropdown list. In the example, we have selected NCT of Delhi.

Step 3: You will need to fill an application. On the homepage, go to the ‘Downloads’ tab and select the application that you require. Suppose, the relevant application is the one where the stamp duty payment is less than Rs 501. Simply download the form and fill it.

Step 4: You will need to submit this form along with the payment, for the stamp certificate.

Step 5: Citizens are required to carry a print out of the Online Reference Acknowledgement No. and visit the nearest Stock Holding Branch to take a final print out of the e-stamp certificate.

 

How to pay Chhattisgarh stamp duty offline?

In this mode of stamp duty payment, you have to purchase stamp paper of the required value from a licenced stamp vendor for his sale instrument, if the value of stamps does not exceed Rs 50,000.

Franking

Through franking, authorised banks in India stamp property purchase document or affix a denomination on it. This acts as a proof that the stamp duty for the transaction has been paid.

 Now, suppose ratan Shahi is buying a property in Raipur in 2024. Here is how much money he would pay as stamp duty and registry fee to the Chhattisgarh government for property worth Rs 50 lakh:

Stamp duty applicable: 5% of Rs 50 lakh= Rs 2.5 lakh

How to calculate the property registration charges in Chattisgarh?

Calculating property registration charges in Chhattisgarh involves determining both stamp duty and registration fees, which are essential components of the property registration process.

As, we have already discussed how to calculate the stamp duty in Chattisgarh, let’s move on to the calculation of property registration charges in Chattisgarh.

 

Registration charges calculation

In Chhattisgarh, the registration fee is 4% of the property’s market value, applicable to all buyers regardless of gender.

Example: For a property valued at ₹10,00,000, the registration charge would be:

  • Registration Charge: 4% of ₹10,00,000 = ₹40,000

Total Charges:

  • For men: Stamp Duty (₹50,000) + Registration Charge (₹40,000) = ₹90,000
  • For women: Stamp Duty (₹40,000) + Registration Charge (₹40,000) = ₹80,000

Additional Considerations:

  • Exemption Threshold: Registration charges apply only to properties valued above ₹50,000. For properties valued at ₹50,000 or below, the registration charge is ₹500. 

Refund Policy: Under Rule 120 of the Chhattisgarh Registration Rules, 1939, refunds for registration charges are claimable if the amount paid exceeds the authorised scale. The refund claim must be lodged within three months from the date the party realises the refund is claimable.

 

Chhattisgarh property registration act, Section 25

Section 25 of the Registration Act, 1908 mandates that all documents required for registering a property deed must be presented to the competent registrar officer within four months from the date of execution. Failure to comply with this timeframe results in a penalty of up to ten times the amount of the property registration fee.

In Chhattisgarh, this provision is enforced under the Chhattisgarh Registration Rules, 1939. According to Rule 16 of these rules, if a document is presented for registration after the prescribed period, the registering officer advises the presenter to apply for an extension of time under Section 25 of the Act. Such an application is forwarded to the Registrar, and proceedings are suspended pending receipt of an order. If the document is presented after the extreme period of limitation (eight months) has expired, registration is refused immediately.

Refunds on stamp duty in Chhattisgarh apply exclusively to e-stamps. To initiate the refund process, an individual must submit a form to the Collector, detailing all relevant information from the e-stamp certificate, such as the name, certificate number, ID and application date. Once reviewed, the Collector will arrange for the refund, deducting ten percent as a service charge.

Refund of registration fees in Chhattisgarh is governed by Rule 120 of the Chhattisgarh Registration Rules, 1939. According to this rule, refunds can be claimed under the following conditions:

  • If the registration fee paid exceeds the authorized scale. 
  • The refund claim must be submitted within three months from the date the party becomes aware that a refund is applicable.

 

How to register property in Chhattisgarh?

Step 1: To register property online, login to the department’s website www.epanjeeyan.cg.gov.in. After logging into the website, click on the registration menu.

Step 2: After clicking on the self-registration menu, the login page will open. Click on the New User option on the menu. Create your user ID and password.

Step 3: Provide your name, mobile number, email ID, password to register.

Step 4: After registering, click on Home and log in by entering your mobile number and password.

Step 5:After logging in, you will find new property registration. Click on it and fill all the details as shown in the image below.

Step 6: After verifying all the details hit the submit button.
