Atone for Amrapali mess: SC tells Noida Gr Noida authorities

This entire problem has arisen because of your policy, the SC told the two authorities.

Noida and Greater Noida authorities faced the Supreme Court (SC) ire on October 10, 2022, for refusing to cooperate in the Amrapali resolution case. The apex court observed that the two authorities were responsible for the Amrapali debacle and must come up with an out-of-the-box thinking to find a solution.

The remark by a bench of Chief Justice UU Lalit and Bela M Trivedi was made after the authorities vehemently opposed a plea, seeking sale of unused floor space in Amrapali projects to generate additional funds to complete stuck projects.

“You are party to this problem, and you are partly responsible for the problem. So, you must find the answer. You can make an exception for the Amrapali project and devise a policy. This entire problem has arisen because of your policy. Mistake was committed by you and you have to atone for it. Some out-of-box solution is needed,” the bench told senior advocate Ravindra Kumar, appearing for the authorities.

“If you come out with helping hands then the projects would become viable and money would be pumped in them and we would ensure that you get your dues,” it added.
In 2019, the two authorities were reprimanded by the top court for colluding with the builder, thereby cheating thousands of homebuyers.

“The Noida and Greater Noida authorities and the bankers have permitted diversion of funds of homebuyers and the possession of other assets by Amrapali Group. The buyers’ money had been diverted, which was meant for construction on payment of dues to authorities. In case they were paid timely by the Amrapali Group to the authorities and to the banks, substantive liability would have been cleared. But by their inaction and rather connivance, the buyers were cheated by the Amrapali Group. Authorities did not object when mortgages were effected in favour of banks in violation of conditions (sic),” the apex court said in an order in 2019.
