DDA luxury flats sold out in Dwarka yet to receive RERA approval

According to the RERA regulations, the RERA certifies projects with a registration number before the developer can start promotions.

March 27, 2024: The Delhi Development Authority (DDA) has witnessed the sale of 1,124 luxury flats out of a total of 1,130 luxury flats facing the golf course in Sector 19 B, Dwarka, in its latest scheme. The scheme was announced in October 2023. However, the project is not yet registered with the Real Estate Regulatory Authority (RERA), according to a report by Hindustan Times.

According to the RERA regulations, the RERA certifies projects with a registration number before the developer can start promotions. The process of certification takes around a month if all requirements have been fulfilled. The developer can apply for the certification while launching the project before construction.

In October 2022, RERA asked DDA to ensure that its new development projects were registered with RERA. However, the application for RERA registration for the Dwarka flats was moved only after the first round of auctions held in October 2023, the report said. Over 600-odd allottees met DDA officials and also wrote to the lieutenant governor, who serves as the chairperson of DDA, to present their concerns. As cited in the report, a DDA spokesperson said that all mandatory clearances required as per law will be taken by DDA before possession is handed over. The terms and conditions of the scheme were mentioned in the brochure and communicated widely in advance through the DDA’s official website as well as SBI’s e-tender website. Adequate time was given to bidders to inspect the flats by making onsite visits and to understand the terms and conditions provided in the brochure. This was additionally facilitated through housing melas organised at the site, helpdesks at DDA and project sites, he said.

The media report said that in an order dated December 6, 2023, RERA flagged that DDA was violating Section 3 of the RE (RD) Act, 2026, by advertising the project without registration with the body.

As per the report, DDA officials said that the agency was making all efforts to complete the project by June 2024 and the allottees will have to pay the remaining 25% only at the time of completion of the project and the flats are ready for possession.

The DDA, through its special housing scheme, offered newly constructed penthouses in Dwarka’s Sector 19B. The project includes 14 duplex penthouses, 170 super high-income group (super HIG) flats and 946 high-income group (HIG) flats. The prices of flats range from Rs 2 crore to Rs 5 crore.
