October 13, 2023: The Western Zone Bench of the National Green Tribunal (NGT) on October 11, 2023, has barred the City and Industrial Development Corporation (Cidco) from leasing the 25,000 sqm plot located adjacent to NRI Complex, Seawoods in Nerul. Under this order, the land demarcated as plot no 2A in sectors 54, 56 and 58 of Nerul (West) cannot be sold, transferred or granted any leasehold by Cidco.
According to media reports, the NGT has directed Cidco to develop the land according to the draft development plan of the Navi Mumbai Municipal Corporation (NMMC). Under this plan, the space has been marked to be developed as a social facility and garden.
According to media reports, Cidco is exploring further legal options.
Cidco in August 2022 announced e-auction of the plot no 2A in sectors 54, 56 and 58 in Nerul (West). Spread over 6.21 acre, the land that fell under the Coastal Regulation Zone (CRZ) was quoted to have a base price of Rs 1.17 lakh per sq metre. Cidco had fixed the earnest money deposit (EMD) for this land at Rs 29.49 crore.
However, the plot went under litigation after the NGT on August 22, 2022, put a stay on the auction after admitting petitions from two sets of group- the Navi Mumbai Environment Preservation Society (NMEPS) and a group of citizens on no development on this land, which was a part of the CRZ.
Under the recommendation of the Maharashtra Coastal Zone Management Authority (MCZMA) and the environment department, the NGT examined the CRZ map prepared by the National Centre for Sustainable Coastal Management (NCSCM), Anna University to check if the plot fell in the CRZ I, II and III areas to take decision in this matter.
Even while the stay on lease was on, in January 2023, Cidco called off the bidding. Receiving bidding offer far below prevailing market rate for the plot was cited as the reason for this move.
